Most people carry a portable electronic device when they travel — whether that device is a laptop computer, a tablet, or a smartphone — all of which typically are equipped with a digital voice assistant of some type. That digital voice assistant on products that are manufactured by Apple Incorporated is called Siri; and a legal decision has resulted in what one might say, “Hey Siri: $95 million class action settlement”.
Hey Siri: $95 Million Class Action Settlement.
This is your chance to get your share of $95 million from a class action settlement with Apple Incorporated if you owned or purchased a device that was enabled with Siri and experienced an unintended activation of Siri during a confidential communication or private communication between Wednesday, September 17, 2014 and Tuesday, December 31, 2024…
…but you must submit your valid claim using this form no later than Wednesday, July 2, 2025 at 11:59:59 in the evening Pacific Daylight Time; and you must be a legal resident of the United States in order to be a member of the class action lawsuit settlement.
A class action lawsuit was filed against Apple Incorporated in which the plaintiffs alleged that that confidential communications or private communications by current or former owners or purchasers of devices equipped with Siri were obtained by Apple and/or shared with third parties as a result of an unintended Siri activation, and brought claims — including alleged violation of consumer protection laws and privacy laws.
Apple asserts numerous defenses to the claims in this case. The proposed settlement to resolve this case is not an admission of guilt or wrongdoing of any kind on the part of Apple, which denies that:
- Any and all allegations of wrongdoing and do not admit or concede any actual or potential fault, wrongdoing, or liability whatsoever with respect to any facts or claims that have been or could have been alleged in the lawsuit or any similar action; and do not concede any defenses that have been or could have been asserted
- They violated the law and specifically deny that any damages were incuned as a result
- The proposed settlement suggests that the defendants have done anything wrong
- Plaintiffs — as well as the group of individuals that plaintiffs seek to represent — would or would not win their case if it were to go to trial
- Any damages are provable for plaintiffs and/or the members of the class action
The deadline to object to opt out and exclude yourself from the class action settlement — or to object to it — is Wednesday, July 2, 2025 at 11:59:59 in the evening Pacific Daylight Time.
The court will hold a hearing to decide whether to give final approval to the settlement at 9:00 in the morning Pacific Daylight Time on Friday, August 1, 2025 at:
United States District Court for the Northern District of California
Oakland Courthouse
1301 Clay Street
Courtroom 5 – 2nd Floor
Oakland, California 94612
At the final hearing, the court will consider whether the settlement is fair, reasonable, and adequate. If there are objections, the court will consider them.
Final Boarding Call
How I found out about this class action settlement is that I received an e-mail message informing me that I am potentially a member of this class action settlement.
If you do decide to participate in this settlement, completion of the claim form will consume only a few minutes of your time; but do not expect any major windfall, as you will not exactly get rich from this settlement. Members of this class action who file valid claims will be eligible for a share of the remainder of the settlement fund only after attorneys’ fees and other costs are paid — up to a maximum limit of $20.00 per device in the claim for up to five devices — which means that the most you can get from this class action settlement is $100.00. If more people file a claim than expected, then the final financial settlement amount per person will be less than announced…
…which is why I believe that these class action settlements are unfair and little more than a profit generating machine for members of the legal profession.
